Bitmagic Terms of Service

Introduction and Legal Framework Bitmagic Oy (hereinafter “Bitmagic”), registered in Finland with Business ID 3259985-5 and registered address at Teollisuuskatu 22 B 36, 00520 Helsinki Finland, provides an AI-powered game creation platform and related services (hereinafter “the Service”). These Terms of Service constitute a legally binding agreement between you (hereinafter “User” or “you”) and Bitmagic Oy, governed by Finnish law. These Terms comply with the Finnish Consumer Protection Act (Kuluttajansuojalaki), the Finnish Data Protection Act (Tietosuojalaki 1050/2018), and the Act on Electronic Communications Services (Laki sähköisen viestinnän palveluista 917/2014). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. For users within the European Economic Area, these Terms supplement but do not replace your statutory rights under applicable consumer protection laws. 2. Service Description and Access Bitmagic provides an AI-powered platform for game creation and related services. The Service includes access to our software platform, AI generation tools, community features, and associated services. We strive to maintain 99.9% service availability, excluding scheduled maintenance windows. Access to the Service requires meeting minimum technical requirements, including a modern web browser with WebGL 2.0 support and a stable internet connection of at least 5Mbps. Bitmagic reserves the right to modify these requirements as technology evolves. Users are responsible for maintaining the confidentiality of their account credentials and for all activities occurring under their account. Any suspected unauthorized access should be reported immediately to contact@bitmagic.ai. 3. User Eligibility and Account Terms In accordance with Finnish law, users must be at least 13 years of age to use the Service. Users between 13 and 17 years must obtain verifiable consent from a parent or legal guardian before creating an account. For users under 13, verifiable parental consent is required in accordance with Finnish law. Account creation requires: – A valid email address – Accurate registration information – Acceptance of these Terms – Parental consent where applicable Users must maintain accurate account information and notify Bitmagic of any changes. Multiple accounts per individual are not permitted, and account sharing is prohibited. 1. Technical Requirements and Performance Service requires modern web browser, WebGL 2.0, minimum 5Mbps internet. Bitmagic maintains monitoring and load balancing systems following Finnish IT security standards. Performance targets: – 99.9% uptime excluding maintenance – Automated backup systems 11. Commercial Terms Business users subject to additional requirements: – Valid VAT number – B2B invoicing compliance 12. Security Measures Security complies with Finnish cybersecurity guidelines including: – Data encryption – Access controls – Intrusion detection – Regular security audits – Incident response procedures 13. Platform Rules and Community Standards Content prohibited under Finnish law includes: – Hate speech – Discriminatory content – Gambling without license – Unauthorized financial services – Harmful code or malware 14. Liability and Insurance Liability limitations follow Finnish law. Bitmagic maintains required business insurance coverage. 15. Updates and Maintenance Scheduled maintenance communicated 7 days in advance. Emergency maintenance may occur without notice. 16. Final Provisions Agreement effective upon acceptance.
